Bard Pushes For Costs In Dropped Vaginal Mesh Bellwether

Bard Inc. on Friday insisted it is entitled to costs for a bellwether vaginal mesh lawsuit dropped weeks before a West Virginia trial, saying the plaintiffs unreasonably delayed dismissal and forced Bard to continue preparing for a trial that would never occur.
Bard claims that plaintiffs Linda and Ronald Rizzo's voluntary dismissal was unnecessarily belated and thwarted their reasonable expectation that the case was going to proceed to trial, particularly in light of the fact that the case was selected as a bellwether in multidistrict litigation brought by thousands of women claiming Bard's transvaginal surgical mesh implants caused them internal...
