Law360, Philadelphia (January 2, 2014, 4:10 PM EST) -- The Pennsylvania Superior Court will not rehear arguments in a negligence suit seeking to hold a Dow Chemical Co. unit responsible for a cancer cluster allegedly caused by toxic chemicals, letting stand a three-judge panel's October decision reviving the case.
The court said it would not re-examine the case following an October decision that found a judge in the Philadelphia County Court of Common Pleas had improperly dismissed the suit before plaintiff Joanne Branham could finish making her case that Rohm & Haas Co. caused a cancer cluster near an Illinois plant after improperly disposing of toxic chemicals.
