Jury Clears Abbott In Tainted Formula Injury Suit

Law360, New York (January 17, 2014, 7:28 PM EST) -- Abbott Laboratories won a defense verdict Friday in a federal case alleging that a bacterial contamination in the company's powdered infant formula caused a newborn to develop meningitis and related brain damage.

A federal jury in Iowa absolved Abbott of design, manufacturing and warning defect claims over allegedly tainted Similac NeoSure formula brought by plaintiff Security National Bank of Sioux City, Iowa, which sued as the conservator for an injured baby referred to in court documents as JMK.
