Catholic Co. Says Religious Rights Rebuff Birth Control Rule

Law360, Washington (February 25, 2013, 8:01 PM EST) -- A Catholic-owned company urged the Tenth Circuit on Friday to affirm its court-ordered exemption from the Affordable Care Act's contraception mandate, saying the Constitution does not prohibit companies from exercising religion and the government's objections to the decision are “artificially constructed.”

Heating and air conditioning systems manufacturer Hercules Industries Inc. blasted the government's arguments against its preliminary injunction, which temporarily exempts it from being required to provide workers with health insurance that covers birth control, maintaining that owners can exercise religion through their companies.
