ORDER re: 163 Ex Parte Application filed by Bay Area Air Quality Management District: BAAQMD's motion to enlarge the deadlines set by the court in its 5/14/2024 Order 157 is granted in part and held in abeyance in part. The deadline for BAAQMD to file a declaration(s) supporting the claim of law enforcement/official information privilege is extended to 5/23/2024. Plaintiff's response is due by 5/28/2024. As to BAAQMD's request for an extension of the 5/21/2024 deadline to re-review documents withheld under the deliberative process privilege, produce documents for which it withdraws the deliberative process privilege, and produce updated privilege logs, the court orders the following: The court is inclined to grant some extension of the 5/21/2024 deadline; at issue is the length of the extension given the upcoming pretrial deadlines and trial date. BAAQMD has provided information regarding the burden associated with complying with the 5/14/2024 Order. In considering the other applicable Rule 26(b) proportionality factors, Plaintiff has not shown the "importance of [the responsive documents] in resolving the issues, and whether the burden or expense of" BAAQMD's production by the existing deadlines "outweighs its likely benefit." At this juncture, it is not clear to the court how important these documents are to the impending trial and whether BAAQMD should be required to go through a significant review process involving thousands of documents on a relatively short time schedule. Therefore, Plaintiff and BAAQMD shall immediately meet and confer regarding the outstanding documents in light of the proportionality factors, including potentially phasing BAAQMD's re-review and production to focus on the key documents for possible use at trial. By no later than 12:00 p.m. on 5/22/2024, the parties shall file a two-page joint letter setting out their positions and any agreements reached. The court will hold a hearing by Zoom on 5/23/2024 at 1:00 p.m. on BAAQMD's motion to enlarge the remaining deadlines.
