ORDER by Judge Mustafa T. Kasubhai: The Allard Plaintiffs Unopposed Motion for Leave to File a Second Amended Complaint (ECF No. 250 ) is GRANTED. The Court finds that leave to amend is appropriate because although Plaintiffs have previously amended their complaint, they have not acted with undue delay or bad faith, Defendants are not unduly prejudiced by the amendment, and the amendment is not futile. See Eminence Capital, LLC v. Aspeon, Inc., 316 F.3d 1048, 1052 (9th Cir. 2003). The Court declines to adopt the proposed deadline for Defendants' responsive pleadings to the amended complaint, however, because the parties do not justify such an extension with good cause. Defendants may file a motion setting forth good cause to support the extension, but they are cautioned that this Court is unlikely to further delay this case absent a strong showing of good cause.
