Text Order
TEXT ORDER: On 05/08/2026, Plaintiff was granted permission to proceed IFP in this matter. Docket Entry No. 173. As such, Plaintiff is entitled to have Defendants in this matter served by the United States Marshal. See Federal Rule of Civil Procedure 4(c)(3). Plaintiff, however, has filed multiple Complaints in this matter (see Docket Entry Nos. 1 , 7 , 114 , 175 , and 179 ), many improperly, and it is unclear which pleading represents Plaintiff's operative Complaint. More importantly, in Plaintiff's Complaints, Plaintiff appears to assert claims not only on her own behalf, but also on behalf of Mustard Seed Entertainment Group, LLC, and Letitia Jordan Productions. This is impermissible as corporate entities may only appear in federal court through licensed counsel and individuals appearing pro se may not represent third parties in federal court. Coniker v. Monfortoh, No. 23-1507, 2023 WL 7411531, at *1 n.1 (holding "Coniker cannot proceed pro se in this appeal on behalf of Resources Solutions, LLC." (citing Simbraw v. United States, 367 F.2d 373, 373-744 (3d Cir. 1966) (per curiam) (providing that a corporation may appear in federal courts only through licensed counsel); Lazaridis v. Wehmer, 591 F.3d 666, 672 (3d Cir. 2010) (per curiam) (stating that an individual proceeding pro se may not represent third parties in federal court)). Therefore, to the extent Plaintiff continues to proceed pro se in this matter, then no later than 10/02/2026, Plaintiff shall file a Fourth Amended Complaint that asserts only claims on her own behalf. No claims may be asserted on behalf of Mustard Seed Entertainment Group, LLC, or Letitia Jordan Productions. Alternatively, no later than 10/02/2026, Plaintiff shall retain counsel who shall file a Fourth Amended Complaint on behalf of the represented parties. Service of the Fourth Amended Complaint shall be addressed thereafter. So Ordered by Magistrate Judge Tonianne J. Bongiovanni on 9/15/2026. (jem)
