Minute
MINUTE entry before the Honorable Charles P. Kocoras: Plaintiff's motion 20 , which the Court construes as a motion to reconsider under Federal Rule of Civil Procedure 59(e), is denied. Rule 59(e) allows a court to alter or amend a judgment in order to correct manifest errors of law or fact or to address newly discovered evidence. "A 'manifest error' is not demonstrated by the disappointment of the losing party. It is the wholesale disregard, misapplication, or failure to recognize controlling precedent." Oto v. Metro. Life Ins. Co., 224 F.3d 601, 606 (7th Cir. 2000) (cleaned up). While Plaintiff states that it was "brought to [his] attention that the IDHR's continued investigation did in fact, toll[] [his] case while they continued to investigate," Plaintiff provides no legal authority supporting this claim. See Lundy v. Westwood Heights Apartments, LLC, 711 F. App'x 356, 357 (7th Cir. 2018) ("We construe pro se filings liberally, but undeveloped or unsupported contentions are waived."); Wolf v. Scobie, 28 F. App'x 545, 547 (7th Cir. 2002) ("Although we construe pro se briefs liberally, even pro se litigants must support and develop their arguments with legal authority."). Thus, there is no basis that would warrant reconsideration of the Court's dismissal order and Plaintiff's motion is denied. Mailed notice. (sxh, ) (Entered: 05/02/2024)
