Minutes of proceedings [non-document] before Judge Dan Aaron Polster. Day 1 of 2. Beginning on July 7, 2026, the Court conducted a mediation between 11 plaintiffs and Norfolk Southern Corporation. Attorneys Jon Conlin, Andy Jones and Hunter Phares participated on behalf of Plaintiffs. Representatives Matt Lockhart, Will Harden and Justin Dalton participated for Norfolk Southern and were represented by Attorneys Scott Clements, Aaron Ponzo, Maria Hanley, Joe Santoro and Ron Wray. On the second day of mediation, Dan and Drew Huff, Ashley and Mike McKim, James Nulf, Karen Christian, Lynn Gould and Attorney Ron Parry participated by Zoom and/or telephone on behalf of various plaintiffs. Over the course of two full days, the Court resolved the claims of all 11 plaintiffs, which are hereby settled and dismissed. The Court will retain jurisdiction to ensure that the settlement agreements are executed. The deadline for counsel to file final dismissal entries is August 31, 2026. (Court Reporter: n/a.)
