EO: On May 19, 2026, the Court issued:
ORDER ADOPTING FINDINGS AND RECOMMENDATION TO DENY APPLICATION TO PROCEED IN DISTRICT COURT WITHOUT PREPAYING FEES OR COSTS. (ECF No. 8 ).
The Court granted Plaintiff leave to either file another Application to Proceed in District Court Without Prepaying Fees or Costs or pay the required filing fee on or before June 19, 2026. (Id. at p. 1).
Plaintiff was warned that failure to comply with the Court's orders and deadlines would result in the automatic dismissal of this action. (Id. at p. 2).
Plaintiff has not filed a new Application to Proceed Without Prepayment of Costs or paid the filing fee.
Plaintiff's Complaint (ECF No. 1 ) is DISMISSED WITHOUT PREJUDICE for failure to prosecute and failure to comply with the Court's May 19, 2026 Order. See Fed. R. Civ. P. 41(b); Hells Canyon Pres. Council v. U.S. Forest Serv., 403 F.3d 683, 689 (9th Cir. 2005).
The Clerk of Court is directed to CLOSE THE CASE.
