   MEMORANDUM ORDER (Dismissing Plaintiff's Complaint) - For the reasons set forth above, the Court hereby GRANTS Defendants' Motions to Dismiss (ECF Nos. 11 , 17 , 21 ) and DISMISSES WITH PREJUDICE Plaintiff's Complaint (ECF No. 5 ) with respect to Defendants Henrico County, the Henrico County Sheriff's Office, the Sheriff of Henrico County and the Clerk. The Court DISMISSES WITHOUT PREJUDICE Plaintiff's Complaint (ECF No. 5 ) with respect to the six John Doe deputies and clerical staff with LEAVE TO AMEND within fourteen (14) days of this Order. If Plaintiff files an Amended Complaint within fourteen (14) days, the Clerk SHALL reopen the case against the six John Doe deputies and clerical staff. The Court further DENIES Plaintiff's Motion for Limited Discovery and Preservation Order (ECF No. 8 ) as MOOT. Should Plaintiff wish to appeal this Order, he must file a written notice of appeal with the Clerk of Court within thirty (30) days of the date of entry.
