TEXT ORDER entered by U.S. District Judge Sue E. Myerscough on 07/25/2024: The parties have filed a Stipulation of Dismissal with Prejudice (d/e 15 ). The Stipulation states that "this action is dismissed with prejudice," with each party to bear its own attorney's fees and costs. Federal Rule of Civil Procedure 41(a)(1)(A)(ii) states that a plaintiff "may dismiss an action without a court order by filing... a stipulation of dismissal signed by all parties who have appeared." Both Plaintiff and Defendant, through their respective representatives, have signed the filed stipulation. As a result, this case has been dismissed with prejudice. All pending deadlines and settings are vacated. No judgment to enter. Each party to bear its own costs. This case is closed. (DW)
