MEMORANDUM OF STATUS CONFERENCE, ORDER CONCERNING PRETRIAL CONFERENCE AND TRIAL, AND STANDARD FINAL JURY INSTRUCTIONS: The court SET a final pretrial conference for March 1, 2027 at 1:30 p.m. (ET), and a 4-day jury trial to commence at 9:30 a.m. (ET) on March 16, 2027 in the Robert Lowell Miller, Jr. Courtroom in South Bend, Indiana. Notwithstanding any standard schedule herein, the court ordered any motion to exclude a proposed expert under Fed. R. Civ. P. 26, Fed. R. Evid. 702, and Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993), to be filed by December 11, 2026, with the response due January 8, 2027, and reply briefing to proceed by local rule.
