MINUTE ORDER: The Court has reviewed the 32 Status Report, which provides updates and corrects misstatements made by counsel during the September 10, 2026, status conference. Based on the 32 Status Report, the Court ORDERS the following. First, the Court ORDERS the Defendants to produce the remaining non-exempt BIS documents for Parts 1 and 3 expected to be returned from consultation by October 16, 2026. The Court notes that these records were only sent for consultation yesterday, on the eve of the status conference, even though BIS has been reviewing them for months. Second, the Court ORDERS NIST to review and produce any non-exempt portions of the 14 remaining records for Parts 1 and 3 by September 18, 2026. These records have been in review for months and comprise only 111 pages. Third, for the 400 remaining records previously reported as responsive to Parts 1 and 3 that counsel has now clarified are responsive to Part 2, the Court grants NIST's request to provide the requested information by September 16, 2026. But given the age of this case and the inaccurate reporting by the Defendants to date, if any records have not yet been internally reviewed and/or sent for consultation, the Court ORDERS NIST to complete that process by October 16, 2026. Fourth, as for the remaining Part 2 records, based on the timelines reported in the Appendix, the Court ORDERS the Defendants to produce any non-exempt records from all agencies by October 5, 2026, except the multi-agency consultations. Fifth, for the 56 pages of multi-agency consultations, the Court ORDERS the Defendants to submit a plan by September 16, 2026, detailing which agencies need to consult on the documents, what order they will be consulting, and the expected date of completion for each agency.
