MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Elayna J. Youchah on 7/1/2026.
Pending before the Court is Plaintiff's Motion to Seal (ECF No. 176). The Motion seeks to seal four exhibits attached to Plaintiff's Opposition to Defendant's Motion for Summary Judgment. Exhibits 10, 11, and 12 are surveillance videos. Exhibit 2 is a security incident report. The Court finds the compelling reason standard, established in Kamakana v. City & County of Honolulu, 447 F.3d 1172 (9th Cir. 2006), is met as it is applied to Exhibits 10, 11, and 12. The Court further finds the compelling reason standard is met, in part, as applied to Exhibit 2. That is, Exhibit 2 must be redacted to remove from public view non-public details regarding Defendant's internal security procedures, table manager software usage, incident coding, and investigative practices ("Investigation Related Material"). To the extent there is any personal identifying information ("PII") regarding Plaintiff or any other individual, that should also be redacted. However, information that is generally discussed in this case and neither PII nor Investigation Related Material must be left available for public review.
Accordingly, IT IS HEREBY ORDERED that Plaintiff's Motion to Seal (ECF No. 176 ) is GRANTED in part.
IT IS FURTHER ORDERED that Exhibit 10, 11, and 12 to Plaintiff's Opposition to Defendant's Motion for Summary Judgment, found in ECF No. 177, are and shall remain sealed.
IT IS FURTHER ORDERED that the unredacted version of Exhibit 2, also found in ECF No. 177, shall remain sealed.
IT IS FURTHER ORDERED that Plaintiff and Defendant must work together to redact Exhibit 2 removing PII and Investigation Related Material, after which Plaintiff must file the redacted version of Exhibit 2 on the docket. That filing must occur no later than July 13, 2026.
