Order on Motion for Extension of Time to File
ORDER: Defendants' motions for an extension of time to file their motions to dismiss, see 47 and 48 , are granted. The Court amends the briefing schedule for Defendants' anticipated motions to dismiss as follows: Defendants shall serve moving papers and file cover letters confirming service on the docket by October 27, 2026; Plaintiff shall serve opposition papers by November 30, 2026; and Defendants shall serve a reply, if any, and file the fully briefed motions by December 7, 2026. To the extent that Defendant Wyckoff seeks leave alternatively to move for summary judgment, see 48 , Defendant Wyckoff's moving papers shall include legal authority addressing whether the issue raised therein can be addressed on a motion to dismiss. As a courtesy to the Court, the parties shall refrain from filing motion papers until the motion has been fully briefed. See Individual Practice Rules § III.G. The Clerk of Court is directed to mail a copy of the docket sheet to the Pro Se Plaintiff and note mailing on the docket. Ordered by Judge Orelia E. Merchant on 10/6/2026. (MLB)
