ORDER (Ordering New Itemized List of Disputed Issues) - the Court hereby ORDERS Plaintiff to reexamine its itemized list of matters for resolution and submit a new, itemized list to the Government no later than fourteen (14) days from entry of this Order. The Court's previously entered summary judgment briefing schedule shall not be affected by this Order. (See ECF No. 24.) In addition, the Court ORDERS both parties to include a discussion of the Fourth Circuit's opinion in any brief supporting a motion for summary judgment. As the Court has already noted, it will not look favorably upon Plaintiffs continued unwillingness to work with the Government towards an efficient resolution of its claims. If such behavior continues in this case, the Court will consider all appropriate options, including sanctions under Federal Rule of Civil Procedure 11(c). Signed by District Judge David J.
