MINUTE entry before the Honorable John F. Kness: On 05/19/2022, the Court granted Defendant's motion to compel arbitration and stayed the case pending resolution of the arbitral process 153 . Because the parties did not provide any update on the arbitral process, the Court instructed the parties to file a status report on the status of the arbitral proceedings 162 . Plaintiffs filed an individual status report on 11/11/2024 stating that they "declined to arbitrate their individual antitrust claims" 163 . Defendant filed a separate status report on 11/18/2024 stating that, because Plaintiffs have failed to prosecute their case and pursue individual arbitration, the case should be dismissed with prejudice 165 . It thus appears that Plaintiffs have abandoned this action. Accordingly, the case is dismissed with prejudice for failure to prosecute. Enter separate final judgment order.
