MEMORANDUM & ORDER -- As set forth in the attached Memorandum & Order, (1) pro se Plaintiff's application to proceed without prepaying fees or costs is granted; (2) this action is dismissed without prejudice; (3) Plaintiff is cautioned to be mindful of a court's ability to impose sanctions; (4) the Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from the Memorandum & Order would not be taken in good faith and therefore denies in forma pauperis status for the purpose of an appeal, see Coppedge v.
