Text Order
TEXT ORDER: After considering the parties' arguments on the record at the August 24, 2026 status conference, the Court GRANTS IN PART Plaintiffs' request for an extension of the deadline to either file their amended complaint on consent or otherwise file a motion for leave to amend (see Dkt. No. 104 ). The Court will not grant the request sine die, but rather until December 18, 2026, based on Plaintiffs' representations that the Third Circuit's decision as to the pending appeal in this matter is expected to be issued by that time. To explain, Plaintiffs' pending appeal before the Third Circuit may resolve this matter in its entirety or narrow the scope of the case and claims at issue and, therefore, significantly preserve the time and resources of both the Court and the parties. See United States v. Washington, 869 F.3d 193, 220 (3d Cir. 2017) (noting that "matters of docket control and discovery are committed to [the] broad discretion of the district court"); see also Gerald Chamales Corp. v. Oki Data Americas, Inc., 247 F.R.D. 453, 454 (D.N.J. 2007) (same). Besides delay, Gateway Defendants have not sufficiently demonstrated that they would suffer any material prejudice from Plaintiffs' request. Instead, it seems clear that the outcome of the Third Circuit's decision will provide clarity as to the direction of the operative pleadings in this matter, as stressed by Plaintiffs. It also will ensure that this matter proceeds in the most efficient manner, i.e., that all defendants respond to the operative complaint at the same time (see Dkt. No. 63 , staying Federal Defendants' time to respond to the Complaint). Thus, should Plaintiffs wish to do so, no later than December 18, 2026, they shall either file their amended complaint on consent or their motion formally requesting leave to amend. However, as previously noted, before filing any motion, Plaintiffs shall meet and confer with all defendants to discuss whether defendants consent to the proposed amendment. Importantly, should the Third Circuit issue its decision prior to December 18th, the parties shall promptly update the Court. So Ordered by Magistrate Judge Jose R. Almonte on 8/24/2026. (akw, )
