ELECTRONIC ORDER: Before the Court is Movants AVM-AUS LTD. and Lone Starr Multi-Theatres L.P.'s Motion for Return of Property Pursuant to Fed. R. Crim. P. 41(g). The Clerk of the Court is directed to file this Motion into a new Civil Action with direct assignment to Judge Ed Kinkeade and referred to Magistrate Judge Renee Harris Toliver. See Harbor Healthcare Sys., L.P. v. United States, 5 F.4th 593, 599-601 (5th Cir. 2021) (addressing pre-indictment Rule 41(g) motion filed in a civil case); Richey v. Smith, 515 F.2d 1239, 1243 (5th Cir. 1975) (same). The Movant/Plaintiff is ORDERED to pay the $405.00 filing fee for the Civil Action no later than August 13, 2026.
The Clerk of the Court is directed to refund the Misc. Action filing fee of $52.00 to the Petitioner. All future filings shall be filed in the Civil Action. (Ordered by Magistrate Judge Renee Harris Toliver on 7/30/2026) (chmb)
