Pa. Justices Urged To Take Up Fracking Trespass Case

By Matt Fair (July 10, 2018, 9:00 PM EDT) -- A Southwestern Energy Corp. unit is pushing the Pennsylvania Supreme Court to take up an appeal of a controversial decision greenlighting trespassing claims over allegations that a well the company drilled on a property in Susquehanna County allowed it to improperly tap into natural gas trapped beneath a neighboring property.

The appeal bid comes after a Superior Court ruling in April that the so-called rule of capture, which has traditionally shielded drillers from liability for drainage of free-flowing oil and gas from below adjacent properties, does not apply to hydraulic fracturing.
