9th Circ. Slams EPA For Skirting Pesticide Ban Request

Law360, New York (August 10, 2015, 9:07 PM EDT) -- Slamming the U.S. Environmental Protection Agency’s delay in responding to environmental groups’ petition that it regulate a pesticide as “egregious,” the Ninth Circuit on Monday ordered the agency to provide a full and final response by the end of October.

The Ninth Circuit panel granted a petition for writ of mandamus sought by the Pesticide Action Network North America and Natural Resources Defense Council in regard to the pesticide chlorpyrifos, which the groups claim is harmful to human health. The panel did not spare the rod in its opinion.
