Sylvania Wants To Depose Hiscock In Patent Spat

Law360, New York (May 5, 2009, 12:00 AM EDT) -- Lighting company Osram Sylvania Products Inc. has gone after its adversary’s counsel in a patent spat, saying that Hiscock & Barclay LLP’s role in prosecuting the patent-in-suit leaves it open to being deposed.

In a motion to compel filed Tuesday in the U.S. District Court for the Western District of New York, Sylvania contends that Hiscock & Barclay's role in prosecuting a lighting patent requires that they open themselves to Sylvania’s efforts to discover evidence for an inequitable conduct defense.
