Wyeth Hits Sun, Caraco With False Advertising Suit

Law360, New York (May 6, 2009, 12:00 AM EDT) -- Wyeth has lashed out at Sun Pharmaceutical Industries Ltd. and its U.S. unit Caraco Pharmaceutical Laboratories Ltd., alleging the generic-drug manufacturers falsely advertise medication as a generic form of Wyeth's heartburn drug Protonix.

The complaint, filed Wednesday in the U.S. District Court for the Eastern District of Michigan, claims false advertising under the Lanham Act, unfair competition, tortious interference with business expectancy and deceptive trade practices.

At issue is Protonix, a drug manufactured and sold by Wyeth that contains as its active ingredient pantoprazole sodium sesquihydrate....
