Lufthansa Appeals Interim EU Decision In Air Berlin Deal

Law360, New York (January 17, 2018, 8:42 PM EST) -- Lufthansa has appealed a European Commission decision that allowed the German carrier to temporarily take over Air Berlin plane leases under certain conditions while the antitrust watchdog reviewed Lufthansa's bid to acquire two businesses from its bankrupt rival.

Deutsche Lufthansa AG lodged a challenge at the European Union's General Court on Jan. 8. The appeal targets an order the commission issued in late October, known as a derogation decision, that lifted the ordinary limits on the airline's ability to use assets of two Air Berlin subsidiaries...
