1st Circ. Orders Review Of ERISA Case V. Liberty Life

Law360, New York (May 6, 2009, 12:00 AM EDT) -- A federal appeals court has asked a lower court to revisit a lawsuit against Liberty Life Assurance Co. of Boston over its denial of Employee Retirement Income Security Act benefits claims, in light of a recent U.S. Supreme Court decision.

The U.S. Court of Appeals for the First Circuit on Wednesday vacated and remanded its previous judgment against plaintiff Diane Denmark, who brought suit against plan administrator Liberty Life for sitting as both judge and payor over her benefits application.
