Feds Push To Get Clean Truck Supporters' Suit Nixed

Law360 (May 12, 2009, 12:00 AM EDT) -- Roughly a month after a judge rejected the Federal Maritime Commission’s bid to block allegedly anti-competitive aspects of clean truck programs at the ports of Los Angeles and Long Beach, the agency has urged the court to toss a suit filed by proponents of the plan.

The FMC on Monday lodged a motion to dismiss the suit in the U.S. District Court for the Central District of California, claiming a consortium of environmental groups fails to adequately state a claim in its complaint.
