Virginia Tech Must Face Retaliation Claim: Court

Law360, New York (May 13, 2009, 12:00 AM EDT) -- A federal judge has refused to dismiss a retaliation claim in a proposed collective action accusing Virginia Polytechnic Institute and State University of violating the Equal Pay Act, but agreed to narrow the scope of the claim.

Judge James C. Turk of the U.S. District Court for the Western District of Virginia on Tuesday ruled that the retaliation claim could only apply to events that happened after the plaintiff filed a formal complaint.
