Judge Orders Calif. To Reconsider Protecting Pika

Law360, New York (May 18, 2009, 12:00 AM EDT) -- A state court judge has ordered the California Fish and Game Commission to reconsider its decision to reject a petition by the Center for Biological Diversity to list a small mammal, the American pika, under the California Endangered Species Act.

Judge Peter Busch of the Superior Court for the State of California for the County of San Francisco ruled Friday that the state agency had applied the wrong legal standard when evaluating the petition, and sent the petition back to the commission for reconsideration.
