Chemical Co. Liable For Past Contamination: Suit

Law360, New York (May 18, 2009, 12:00 AM EDT) -- A German chemical developer and its predecessors should be liable for contamination caused by petroleum and other toxic materials at the site of a former plastic factory, a suit filed by the site's new owner alleges.

In an amended complaint filed Friday in the U.S. District Court for the Eastern District of New York, 49 Dupont Realty Corp. alleged that it had incurred response, cleanup and removal costs at a site in Brooklyn, N.Y., as a result of Evonik Degussa Corp.'s predecessors' negligence.
