Horned Lizard Listing To Be Re-Evaluated: 9th Circ.

Law360, New York (May 18, 2009, 12:00 AM EDT) -- The U.S. Secretary of the Interior has been ordered to reconsider a decision to withdraw a rule proposing that the flat-tailed horned lizard be listed as a threatened species, after conservation groups and biologists argued the move went against the requirements of the Endangered Species Act.

The ruling, handed down Monday by a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit, reversed a 2007 district court order granting summary judgment in favor of the Secretary.
