Bill Seeks ERISA Coverage For Second Opinions

Law360, New York (May 19, 2009, 12:00 AM EDT) -- A new bill introduced Tuesday by Rep. Susan Davis, D-Calif., proposes adding mandatory coverage under the Employee Retirement Income Security Act, Public Health Service Act and Internal Revenue Code for employees seeking qualified second opinions on medical treatment.

The Right to a Second Medical Opinion Act of 2009 would require employers to cover at least three sessions with an approved physician, either in or out of the network of doctors provided by the health care plan, for the same cost to employees as a comparable visit...
