Insurance Disputes Over Aurora Organic Milk Merged

Law360 (May 21, 2009, 12:00 AM EDT) -- A federal court has consolidated two suits stemming from whether insurers have a duty to defend Aurora Dairy Corp. in a slew of consumer class actions claiming the company’s milk was falsely certified as organic.

Magistrate Judge Craig B. Shaffer of the U.S. District Court for the District of Colorado on Wednesday agreed to combine Aurora’s suit against Nationwide Agribusiness Insurance Co. with a group of insurers’ declaratory judgment action against the Boulder, Colo.-based milk supplier.
