GSK Argues Outside Sales Exemption In OT Suit

Law360, New York (May 26, 2009, 12:00 AM EDT) -- In a bid to stop a proposed collective action, GlaxoSmithKline PLC is asking a federal court to determine its pharmaceutical sales representatives are exempt from federal overtime regulations because what they do constitutes outside sales.

The pharmaceutical giant argued in a motion for summary judgment Friday that the plaintiffs worked as salespeople even though money did not change hands during their visits to promote the drugs to physicians, according to documents in the U.S. District Court for the District of Arizona.
