NLRB Allows St. Barnabas Residents To Unionize

Law360 (May 26, 2009, 12:00 AM EDT) -- The National Labor Relations Board has handed a victory to a group of resident physicians at St. Barnabas Hospital in New York who have been seeking to unionize, rejecting the hospital's argument that the residents are students, not employees.

In the ruling, NLRB Regional Director Celeste J. Mattina concluded that the residents are employees with a right to unionize, and said a union election should be held within 30 days.
