FCC Ban On Cable Agreements Legal: DC Circ.

Law360, New York (May 26, 2009, 12:00 AM EDT) -- The Federal Communications Commission was within its legal rights to ban exclusivity agreements between cable companies and owners of apartment buildings after finding that such deals have an anti-competitive effect, a federal appeals court has ruled.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit agreed with the FCC in a ruling Tuesday that the deals — which involve a cable company exchanging a valuable service like wiring a building for the exclusive right to provide service to the residents...
