How The End Of PTAB Partial Reviews Will Impact Courts

Law360 (April 25, 2018, 9:14 PM EDT) -- The impact of the U.S. Supreme Court's ruling that the Patent Trial and Appeal Board must decide all challenged patent claims in America Invents Act reviews will reverberate well beyond the board, including to the Federal Circuit, which will likely see a spike in its workload.

The Supreme Court's ruling Tuesday in SAS Institute v. Iancu upended the PTAB's practice of being able to select a subset of challenged claims on which to rule. The justices said the board must decide every claim that is challenged in a petition for review.
