Federal Preemption Dooms OT Action V. US Steel

Law360 (May 29, 2009, 12:00 AM EDT) -- Finding that claims under state labor law are preempted by the federal Labor Management Relations Act, a federal judge has dismissed a proposed wage-and-hour class action against U.S. Steel Corp.

Judge Ann D. Montgomery of the U.S. District Court for the District of Minnesota on Wednesday granted U.S. Steel's motion to dismiss the complaint, which accused the company of failing to pay overtime wages for pre- and post-shift lag time in violation of the Minnesota Fair Labor Standards Act.
