TVA Says Pollution Suit Ruling Would Cost $1B

Law360, New York (June 1, 2009, 12:00 AM EDT) -- The Tennessee Valley Authority has appealed a judge's order to reduce emissions at four of its coal-fired plants, claiming the upgrades would cost the beleaguered public power provider $1 billion beyond what it already planned to spend on pollution controls.

On Friday, TVA appealed the ruling in the common-law nuisance lawsuit brought by North Carolina to the U.S. Court of Appeals for the Fourth Circuit in Richmond, Va. North Carolina had claimed that TVA pollutants were drifting into the state and sickening residents.
