Procaps Hits Carlton Fields With $15M Malpractice Suit

By Dani Kass (May 24, 2018, 7:46 PM EDT) -- Procaps SA has brought a $15 million malpractice suit against Carlton Fields in Florida state court, accusing the firm of encouraging it to bring a disastrous antitrust suit against its former partner and not disclosing that the Colombian drugmaker could be left on the hook for attorneys' fees if it lost.

Carlton Fields should have told Procaps to accept a proffered settlement instead of going to court, or, at a minimum, advised the company on the risks of bringing a suit under Florida's Deceptive and Unfair Trade Practices Act, Procaps argued in Tuesday's suit.
