Aurora Organic Milk MDL Tossed Due To Preemption

Law360 (June 4, 2009, 12:00 AM EDT) -- A federal judge has dismissed all remaining claims in a multidistrict litigation against Aurora Dairy Corp. and several U.S. retailers alleging that Aurora sold milk falsely certified as organic, finding that the plaintiffs' claims are preempted by federal law.

Judge E. Richard Webber of the U.S. District Court for the Eastern District of Missouri ruled Wednesday that the federal Organic Foods Production Act and National Organic Program were intended to create uniform federal standards for organic labeling, precluding state law claims over labeling practices.
