ACLU Suit Spurs Debate Over Gene Patents

Law360 (June 5, 2009, 12:00 AM EDT) -- The American Civil Liberties Union’s unprecedented attack against patents on genes linked to breast and ovarian cancer as unpatentable and unconstitutional has struck a nerve in the intellectual property community.

The lawsuit, filed against Myriad Genetics in May in the U.S. District Court for the Southern District of New York, is being closely watched and has already drawn sharp divisions between those rooting for and against the ACLU.
