Apple, Fitbit Get Health Sensor Patent Invalidated At PTAB

Law360 (June 1, 2018, 7:18 PM EDT) -- Apple Inc. and Fitbit Inc. successfully showed that a Valencell Inc. patent covering wearable technology that measures various heath metrics is obvious and therefore invalid, the Patent Trial and Appeal Board found Thursday, knocking out one of the patents in infringement suits Valencell brought against Apple and Fitbit.

In the final written decision penned by Administrative Patent Judge Brian J. McNamara, the three-judge panel considered several prior patents presented by Apple and Fitbit, ultimately deciding that claims one through 12 of Valencell’s U.S. Patent Number 8,929,965...
