Qwest Loses Bid To Decertify Class In FLSA Suit

Law360, New York (June 5, 2009, 12:00 AM EDT) -- A federal judge has rebuffed Qwest Communications International Inc.'s bid to decertify a class action brought by current and former network technicians alleging the company forced them to work off the clock to meet productivity standards.

In an opinion Thursday, Judge Ann D. Montgomery of the U.S. District Court for the District of Minnesota also ruled that the claims of 91 consent plaintiffs should be dismissed with prejudice for failing to comply with discovery.
