Abbott Accuses DOJ Of 'Massive' Spoliation

Law360, New York (June 5, 2009, 12:00 AM EDT) -- Abbott Laboratories has filed a motion seeking sanctions against the U.S. Department of Justice, accusing it of spoliation of evidence “on a massive scale” in the antitrust suit alleging that the pharmaceutical industry conspired to artificially boost wholesale drug prices.

In a motion filed Thursday in the U.S. District Court for the District of Massachusetts, Abbott alleges that the DOJ did not implement a document hold until 2007, more than 11 years after the qui tam suit that prompted the investigation was filed.
