Supreme Court Asks For SG's Take On Vaccine Suit

Law360, New York (June 8, 2009, 12:00 AM EDT) -- The U.S. Supreme Court on Monday asked the solicitor general to weigh in on a Georgia Supreme Court finding that a federal law does not shield vaccine makers from state design-defect claims.

In an order, the high court asked the Office of the Solicitor General to offer its views on American Home Products Corp. v. Ferrari et al. The case pivots on the question of whether the National Childhood Vaccine Injury Compensation Act preempts design-defect state law claims against vaccine makers GlaxoSmithKline PLC and Wyeth Inc.,...
