11th Circ. Sends Cancellation Question To Ga. Court

Law360, New York (June 8, 2009, 12:00 AM EDT) -- A federal appellate court certified a question to the Georgia Supreme Court on Tuesday, asking the justices to decide whether a notice of cancellation is ineffective because it provides an opportunity for an insured to keep a policy by paying the past-due premium within 10 days.

A three-judge panel of the U.S. Court of Appeals for the 11th Circuit certified the question in Tuesday's decision. The appellate court also found that a lower court had subject matter jurisdiction because the amount of the controversy exceeds $75,000...
