DirecTV Loses Bid To Dismiss Charter Attack Ads Suit

Law360 (June 9, 2009, 12:00 AM EDT) -- A judge has refused to dismiss a suit by bankrupt Charter Communications Inc. alleging that rival DirecTV Inc. has run false advertisements under the Lanham Act claiming Charter is unable to provide certain programming and features because of its bankruptcy.

In a brief order Friday, Judge Rodney W. Sippel of the U.S. District Court for the Eastern District of Missouri stated without elaboration that DirecTV's motion to dismiss the Lanham Act claims “must be denied.”
