Conditional Class OK'd In Meat Processor FLSA Suit

Law360, New York (June 10, 2009, 12:00 AM EDT) -- A federal judge has conditionally certified a collective action accusing Greater Omaha Packing Co. Inc. of not paying workers for pre- and post-shift activities such as donning and doffing protective equipment and waiting in line to receive knives and other necessary supplies.

In an order Tuesday, Judge Joseph F. Battaillon of the U.S. District Court for the District of Nebraska certified a class in the consolidated Fair Labor Standards Act case. In doing so, he adopted the recommendations of Magistrate Judge Thomas D. Thalken.
